BSCI Audit in Vietnam: is there sufficient evidence that the auditee (manufacturer) provides legal social benefits to workers?
The auditor must verify that the collective bargaining agreement contains additional social benefits beyond those mandated by law. If so, to assess the issue within the context of collective bargaining agreements, the auditor must state the absence or failure to properly pay social benefits.
Validity: In order to verify the validity of the way the auditee (manufacturer) gives social benefits, the auditor must evaluate at least: 1.The auditee (manufacturer) gives social benefits in addition to the minimum wage, and this is not the way workers are allowed to earn the minimum wage.
2. The auditee (manufacturer) also gives social benefits to all workers including:
Seasonal worker
Workers who are paid according to their productivity
Guest workers or any other vulnerable group of workers
3. The auditee (manufacturer) understands that social benefits usually include:
pension
Testamentary pension
Family benefits and maternity leave
medical
unemployment
Sick leave
disability
Industrial injury compensation
During the holiday
The auditee (manufacturer) has signed commercial insurance covering social benefits.
Commercial insurance: If national regulations permit the use of commercial insurance as a substitute (in whole or in part) for public social programs, the auditor must positively evaluate the auditee (manufacturer). - If national regulations do not allow such alternative insurance, but the worker is equally insured, the auditor shall state that the auditee (manufacturer) meets some of the requirements and details the circumstances, if the auditee (manufacturer) is allowed to enforce the social welfare exemption.
Social welfare exemptions: The auditee (producer) may submit a letter of approval (e.g. a union collective bargaining agreement) issued by a local Labour authority or any other authority indicating that it is legally permitted to enforce social welfare exemptions. This exemption must:
Release according to corresponding procedures
Issued by an authoritative statutory body
Valid for current period
Applicable to the auditee (manufacturer) The auditee must have original documents supporting these exemptions.
Conformity check: In addition, the auditor must assess whether the auditee (manufacturer) provides social benefits to workers in a manner consistent with BSCI values and principles. Is the hiring manager aware of the (legal) social benefits available to workers and details the benefits in accordance with the hiring process? The auditee (manufacturer) undertakes to provide workers with routine information regarding social benefits.
